I live in Lackawanna county. My sons mother lives in monroe county. My son is living with my mother in law in northampton county, which is where my child support goes. There has never been a custody order in affect. Where would i file for a custody hearing? Its making me crazy what these two people have put me through.

Thank you for contacting Pennsylvania FACE.  We are here to help.  Disclaimer: We are not attorneys, so we are not giving legal advice.  We are parents, mostly fathers, that are sharing our experience on what has worked, what doesn't work, and what might work.  The organization is run entirely be volunteers.  We try to do the best that we can, but can't always guarantee an immediate reply.

As to the situation that you present, since the support order is in Northampton County and since your child has most likely lived with grand-parents for more than six (6) months, it would be best to file for custody in Northampton County.  It is possible that forms to do so are available on the Northampton County Court website.

Should you want to discuss this situation in more detail, please either attend a regularly scheduled meeting of Pennsylvania FACE (please see the meetings page of our website) or contact us via e-mail or our hotline (toll free 877 4PA-FACE, 877 472-3223).  In addition, as always, you can post a follow-up to this reply.

Should you find our assistance useful, please consider making membership to PA FACE or any contribution that you can.  Information to do so can be found on the Join (http://www.paface.org/content/want-join-pa-face-heres-how), Donors (http://www.paface.org/content/top-donor-list-contribution-will-place-you-wall-gratitude) or Brochure (http://www.paface.org/content/pa-face-informational-brochure) pages of our website.
