My son turned 18 May 17th and his last day of school was May 21. however he failed a class and in order to receive his diploma he must attend summer school from June 21 to July 9th. The cost of the class is $100.00 dollars. I currently pay $720.00 a month. His mother advised Domestic Relations that our son wont be emancipated til July 9th. MY argument is that his attendance to summer school is his sole decision and she can not force him to attend and she should not be entitled to any money other than maybe 50 dollars for the class. Domestic relations stated I had to pay does anyone think I can appeal

Since the PA statues indicate that either your child must be 18 or graduate high school (the later) - and since your child is going to summer school to still achieve his diploma - you will still be accountable to pay his portion for the class.  If your child goes - then your new emancipation date is July 9th.  There is little chance to appeal at this time.

If your child drops out and doesnt go - then you may have a case not to pay - since this will be your child's decision and now 18.

Best of luck,
