Submitted by toby123 on Mon, 01/27/2014 - 14:32

We have a court date set for March.  I am doing this on my own Pro Se.  What should I know before I go into court?

Thank you

From what I see, you are attempting to get more visitation in Ohio.

Ohio requires that there be a substantial cange in circumstance for the child to modify a current custody order. Not knowing what county you are in leaves me a little in the dark as to where you are trying to do this.

As most orders are currently written as shared parenting in Ohio the case law that controls this is Fisher v Hasenjager. http://scholar.google.com/scholar_case?q=Fisher&hl=en&as_sdt=4,36&case=4958712469569789551&scilh=0

May want to visit www.ohiofamilyrights.info for more info and you can use the contact page for more direct input.

When is your hearing?  Are you prepared?  What questions do you have?  Some advice is to have what ever proof you can compile and have your story of what you're asking the judge to do for you.

Also, see if Ohio has a list of statutes like Pennsylvania does for changing parenting time ... 5328. Factors to consider when awarding custody ... http://paface.org/content/pa-custody-statutes-and-support-guidelines.  Before the hearing write your reasons for each item on this list.
