Mother and child relocated out of Philadelphia to North New Jersey (99miles). Father lives in Philadelphia. Mother filed relocation in November 2017, Father objected to the relocation, filed counter-affidavit within 30 days. On January 29, 2018 mother did not bring child to school. Happened for several days. Called mother up and asked why child is not in school. She had moved up to her sister and brother-in-law residence up in north new Jersey (Bergen county), Place the child in the elementary school there. The child is 6yrs old (first grade).
Filed petition for emergency relief custody. Hearing date was set for Feb8, 2017. Cancelled for that date due to Eagles parade.
Feburary 27 was the new date for hearing. So I filed another emergency relief custody and this time will child being absent from school notice and much more evidence. Refuse to grant me a warrant to bring the child back to Philadelphia. Have to wait till Feburary 27. I have also filed a petition for contempt of custody. What can I do at this time. Please help or assist I have not seen my son for two weeks already. I was able to talk to him one time last week and twice this week. My custody time is from Wednesday after school till Saturday at 9pm return to mother.
Right now the mother has not returned the child. What can I do at this point. Please help. Thank you
